These Terms of Service ("Terms") form a binding agreement between you and 4thScene LLC ("Zamo", "we", "us") governing your access to and use of the Zamo mobile application and web service (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service. This document is a starting template; have it reviewed by counsel before relying on it.
1. Account eligibility
You must be at least 13 years old (16 in the EEA) to create an account and agree on behalf of yourself. If you're using Zamo for an organization, you represent that you have authority to bind that organization. Provide accurate information and keep your credentials secure; you are responsible for activity under your account.
2. The Service
Zamo helps you turn goals into actionable plans and track daily progress through journeys, tasks, milestones, journals, and the PIX (Performance Index). Some features are AI-assisted; AI output may be inaccurate, biased, or incomplete and is provided for informational purposes only — not as legal, medical, financial, or professional advice. You are responsible for evaluating AI suggestions before acting on them.
3. Subscriptions, billing, and trials
Paid plans are billed in advance on a recurring basis (monthly or yearly) through Stripe. By subscribing you authorize Stripe and us to charge your payment method for the chosen plan plus applicable taxes. Subscriptions renew automatically at the then-current rate until cancelled. You can cancel anytime from /account/billing; cancellation takes effect at the end of the current billing period and we don't prorate refunds for partial periods unless required by law. Free trials, if offered, automatically convert to paid subscriptions at the end of the trial unless cancelled before the trial ends.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or harassing purposes
- Attempt to access another user's account or content without consent
- Probe, scan, reverse engineer, or interfere with the Service's security
- Submit prompts intended to generate content that is illegal, defamatory, infringing, sexually explicit involving minors, or that violates the acceptable use policies of our AI providers
- Resell or commercially redistribute the Service without our written consent
- Use automated means to scrape, mirror, or extract data at scale
We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity.
5. Your content
You retain ownership of the goals, tasks, journals, and other content you create on Zamo ("Your Content"). You grant Zamo a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display Your Content solely as needed to operate and improve the Service for you.
You are solely responsible for Your Content and must have the right to submit it. Don't upload anything you wouldn't want processed by third-party AI providers, since some Service features route content to large language models on your request.
6. AI-generated content
Outputs generated by Zamo's AI features ("AI Outputs") are provided as-is. Multiple users may receive similar outputs from similar prompts; AI Outputs are not exclusive to you. You are responsible for verifying any AI Output before relying on it. Zamo makes no warranty that AI Outputs are accurate, complete, current, or fit for any particular purpose.
7. Third-party services
The Service integrates third parties including Stripe (payments), Supabase (auth, database, storage), Apple, Google, Firebase Cloud Messaging, OpenAI, Anthropic, and Google AI. Your use of those services is governed by their own terms and privacy policies.
8. Intellectual property
Zamo, the Zamo name and logos, and the underlying software are owned by 4thScene LLC and protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to you. Feedback you send is non-confidential and may be used by us without restriction or compensation.
9. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if continued provision becomes commercially impracticable, or if required by law. Sections that by their nature should survive termination (ownership, disclaimers, limitations of liability, governing law) survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAMO DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAMO AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD 100, WHICHEVER IS GREATER.
12. Indemnification
You agree to defend and indemnify Zamo against claims arising from Your Content, your use of the Service in violation of these Terms, or your violation of any applicable law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction. Where prohibited by local law, mandatory consumer-protection provisions apply.
14. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. Material changes will be announced in-app, by email, or by posting an updated effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
